٣٠٣٩ - حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ، عَنْ دَاوُدَ بْنِ أَبِي هِنْدٍ، عَنْ عَامِرٍ، أَنَّ الْمُعْزِلَةَ بِنْتَ الْحَارِثِ تُوُفِّيَتْ بِالْيَمَنِ وَهِيَ يَهُودِيَّةٌ فَرَكِبَ الْأَشْعَثُ بْنُ قَيْسٍ، وَكَانَتْ عَمَّتَهُ، إِلَى عُمَرَ فِي مِيرَاثِهَا، فَقَالَ عُمَرُ:

«لَيْسَ ذَاكَ لَكَ، يَرِثُهَا أَقْرَبُ النَّاسِ مِنْهَا مِنْ أَهْلِ دِينِهَا، لَا يَتَوَارَثُ مِلَّتَانِ»
